Preamble
These general terms and conditions (hereinafter referred to as "T&C") regulate the legal relations between the owner of the ticket and/or the user of the website www.cestavcase.sk on the one hand and the trading company Creavia s.r.o., ID: 56210469, VAT number: 2122239339, with reg. registered office in M. Kukučín, 96237, Kováčová, registered in the commercial register of the District Court of Banská Bystrica, dept. Ltd., insert no. 49157/S on the other side (hereinafter referred to as "Creavia s.r.o.").
Article I
Introductory provisions and definition of basic terms
- Creavia s.r.o. sells tickets for an experiential exhibition, the main theme of which is the history of the city of Banská Štiavnica and mining itself (hereinafter referred to as the "Exposure").
- Through the online system, available on the website www.cestavcase.sk/vstupenky, as well as through the point of sale, it is possible for all those interested in the Exposition to obtain information about the Exposition, and subsequently sell tickets for the Exposition. Sales points and information about the Exhibition are published on the website www.cestavcase.sk.
- For the purposes of these GTC, the following shall be understood:
- Ticket; value and confirmation allowing its owner to enter the Exhibition for a fee, or to its premises that are currently open to the public on the date and time to which the Ticket applies. After this date and time, the Ticket is invalid. The ticket cannot be offered for resale, returned for sale, exchanged or arbitrarily duplicated. Modifying, copying or falsifying Tickets is in violation of these Terms and Conditions, as well as relevant legal regulations, and may result in administrative-legal as well as criminal-legal consequences. Current Ticket prices are published at the Sales Points and on the website www.cestavcase.sk/vstupenky. The ticket serves for its owner as proof of its purchase.
- To the ticket holder; the person who purchased the Ticket at the Sales Point or through the website www.cestavcase.sk/vstupenky. The owner of the ticket may not further offer the Ticket for sale. The ticket holder acknowledges that different forms of recording (portrait, image, video and audio recording) may be made in the Exposition or in connection with it, e.g. for artistic purposes and for print, film, radio and television reporting.
Article II
Method of purchase, Ticket requirements
- Tickets are purchased and/or reserved on the web portal www.cestavcase.sk/vstupenky in the form of navigation of individual actions that navigate the Buyer to purchase a ticket. The buyer becomes the Owner of the Ticket, or the person selected by him becomes the Owner of the ticket only upon full payment of the purchase price determined according to the current price list. Payment of the purchase price means crediting it in full to the Seller's account or payment to the cash register at the point of sale.
- The buyer is entitled, exclusively after paying the entire purchase price for the ticket, to print it and prove it when entering the Exhibition. The Ticket printed in this way will be accepted by the Seller only if it is printed properly, completely and in its entirety in the form sent by the Seller to the Buyer at the specified e-mail, so that the unique QR code is readable. Tickets will also be accepted, with which the Buyer proves himself digitally on the screen of mobile devices upon entry, but only if such a ticket is identical, complete and whole in the form in which it was sent to the specified e-mail, so that the unique QR code is readable.
Contractual relationship
Creavia s.r.o. ensures the sale of Tickets to the Exhibition and accepts funds corresponding to the purchase price of Tickets to the Exhibition from those interested in the Exhibition. By paying the price of the Ticket, i.e. by purchasing a Ticket at the Sales Point or via the website www.cestavcase.sk, the Ticket Owner enters into a legal relationship with Creavia s.r.o. in relation to the Exhibition. Information about the Exhibition is available at the Sales Points and on the website www.cestavcase.sk. Agreement between Creavia s.r.o. and it is concluded for the Holder of the Ticket for a certain period of time, namely until the visit of the Exhibition on the date and time to which the Ticket applies. After this date and time, the Ticket is invalid.
Article III
Rights and obligations of the ticket holder
- The holder of the ticket is entitled to use the Ticket for one-time entry to the Exhibition on the date and time to which the Ticket applies. After this date and time, the Ticket is invalid. After leaving the area in which the Exhibition is located, the Ticket also loses its validity.
- The ticket holder is entitled to use the services offered at the Exhibition. The owner of the ticket becomes a contractual partner of the given Exhibition by purchasing the Ticket.
- The owner of the ticket is obliged to check the ticket and the information on it immediately after paying the price of the ticket or receiving it at the point of sale, or after printing the Ticket with your own printing and to immediately complain about any errors according to these General Terms and Conditions.
- The owner of the ticket is obliged to keep the Ticket carefully as a tax document. Negligence in use is considered the circumstance when a third party can take possession of the Ticket without much effort and in an illegal manner.
- The owner of the ticket is entitled to use the Ticket only for the purposes for which it is intended. Any other use of the Ticket is prohibited.
- Creavia s.r.o. advises Ticket Holders to inform themselves about possible changes related to the Exhibition for which the Ticket was purchased, including possible cancellation of the Exhibition, at the Sales Points or on the website www.cestavcase.sk.
- By presenting the Ticket when entering the Exhibition, the Ticket Holder expresses his consent to the instructions at the Exhibition venue and the conditions attached to them and undertakes to comply with them. The instructions of the organizing service or the operating procedure of the Event are available either on the website www.cestavcase.sk or published before entering the Exhibition. In case of non-compliance, the Ticket Holder may be prevented from further participation in the Exhibition without the right to any form of refund of the Ticket price and/or other damage to the Ticket Holder.
Article IV
Cancellation of the event
- In case of cancellation of the Exhibition, the funds representing the price of the Ticket are returned to the Ticket Holder without undue delay. Ticket holders are entitled to claim a refund of the entrance fee no later than within 3 years from the planned visit to the Exhibition. The place, time and method of refunding the entrance fee will be announced to the Ticket Holders via the website www.cestavcase.sk.
- The company Creavia s.r.o. is not obliged to return the price of the Tickets to the Ticket Holders, nor to pay them or provide any compensation in the event that the Exhibition is canceled for reasons that were caused by an unavoidable event that does not originate in the operation of Creavia s.r.o. especially but not limited to reasons of force majeure, natural disasters, adverse weather conditions or weather, wars, riots, demonstrations, uprisings, strikes, terrorist attacks or suspicions thereof, or bans on public events or Exhibitions by any public authority, court or law , or for reasons on the part of the Ticket Holder, and all of this even if a replacement Exhibition is not held on a replacement date instead of the canceled Exhibition.
Article V
Payment for tickets
- Anyone interested in the Exhibition can pay for the Ticket via the website www.cestavcase.sk, or at the Sales Point.
- The price of selected Tickets can be paid in the following ways:
- by payment card via the Internet (payment via a virtual POS terminal). Cards issued by any banking institution can be used,
- by payment card or in cash at the Point of Sale.
Article VI
Terms of Delivery
- In the case of purchasing a Ticket, it is not possible to withdraw from the contract and request a refund of the entrance fee, regardless of whether the Ticket was purchased directly at the Point of Sale or via the website www.cestavcase.sk, as pursuant to § 7 par. 6 letters k) Act no. 102/2014 Coll. on consumer protection when selling goods or providing services on the basis of a contract concluded at a distance or a contract concluded outside the seller's premises, the consumer cannot withdraw from the contract, the subject of which is the provision of services related to leisure activities and according to which the seller undertakes to provide these services at the agreed time or within the agreed deadline, while the contract for the purchase of the Exhibition Ticket represents a contract on the basis of which the seller undertakes to provide the Ticket Owner with a free time service, i.e. Exposure, at the agreed time, or the duration of the Exhibition.
- In the case of purchasing a Ticket directly at the Sales Point, it is not possible to withdraw from the contract and request a refund of the entrance fee. The return of the paid Exhibition Ticket is not possible, unless otherwise stipulated in these GTC. It is also not possible to request a refund of the entrance fee to the Ticket Holder in case of non-use of the Ticket.
- In case of loss or theft of the Ticket, the Ticket Owner is obliged to report this event to Creavia s.r.o. as soon as possible. by sending an e-mail message or a written notification in the form of a postal shipment to the address Creavia s.r.o., M.Kukučína, 96237, Kováčová or by phone number +421 949 682 268. In the event that the incident was reported to the police, Creavia s.r.o. is obliged to also submit a police report.
- If the Ticket is damaged, the Ticket Owner is obliged to report this event to Creavia s.r.o. as soon as possible. by sending an e-mail message or a written notification by post to the address Creavia s.r.o., M.Kukučína, 96237, Kováčová or by calling +421 949 682 268 and at the same time presenting the damaged Ticket (or all its parts) and an affidavit describing the manner of damage . Creavia s.r.o. will issue the Ticket Holder a new, replacement Ticket, which will entitle the Ticket Holder to enter the Exhibition for which the damaged Ticket was purchased.
Article VIII
Complaints
- According to these GTC, the seller provides services according to Act no. 40/1964 Coll. of the Civil Code as amended in conjunction with Act No. 102/2014 Coll. on consumer protection when selling and/or reserving goods or providing services on the basis of a contract concluded at a distance or a contract concluded outside the seller's premises as amended and other generally binding legal regulations valid in the territory of the Slovak Republic. The buyer is obliged to make claims for service defects (complaint) without undue delay after finding out the reasons for making a claim, i.e. on the day on which the service was not provided in the agreed or usual scope, quality, quantity and term, otherwise the right to claim expires. The seller is obliged to examine the applied claim and decide on the method of handling the claim within 3 working days, in more complex cases within 30 days from the date of its application. For the purposes of the complaint procedure, the Buyer shall provide his contact information in the scope of name, surname and title, contact address, date of birth, e-mail address, telephone number, or other data. The complaint must be signed. The buyer can ask for the result of the complaint procedure to be sent to the e-mail address; he will state this in the complaint letter. The Buyer is obliged to provide the Seller with any necessary cooperation in resolving the complaint. The seller assesses each claim separately depending on the specific case.
- The seller is not responsible for non-use of the Ticket within the time and date of its validity, nor for non-use of the Ticket due to force majeure, especially adverse weather. The Buyer acknowledges and agrees that the Ticket Owner is entitled at the time and date or to use the Ticket during the Time Validity, but is not obliged to do so. If he does not use his right, the Seller is not responsible for his decision.
Article IX
Final provisions
- The owner of the ticket is obliged to familiarize himself with the wording of the General Terms and Conditions in their current wording before the binding confirmation of the purchase of the Ticket. The wording of the General Terms and Conditions, with which the User familiarized himself before making the purchase of the Ticket, will always be used for the given relationship.
- For all legal relationships between the Seller and the Buyer, or The legal order of the Slovak Republic applies to the ticket holder. Relationships that are not regulated in the Purchase Agreement and these GTC are governed by the provisions of other relevant legal regulations in force in the Slovak Republic.
- These GTC are effective from June 1, 2022.
Privacy
- The seller, as the operator of the Experiential Exhibition Journey in Time, processes the Buyer's personal data in accordance with Act no. 122/2013 Coll. on the protection of personal data and on the amendment and supplementation of certain laws as amended in connection with other generally applicable legal regulations valid in the territory of the Slovak Republic, to the extent of name, surname and title; contact address, date of birth, e-mail address, telephone number, signature. The Seller processes the Buyer's personal data for the purpose of marketing, sales, complaints, records and control of the use of purchased Tickets. The seller processes personal data for the necessary time to achieve the purpose of processing. For marketing purposes, the Seller processes personal data based on the express consent of the Buyer granted by checking the box "I agree to the processing of personal data". The Buyer hereby grants the Seller consent to process personal data in the scope of name, surname and title; contact address, date of birth, e-mail address, telephone number, signature also provided to its business partners for marketing purposes.
- The seller, as the operator of the Experiential Exhibition Journey in Time, processes personal data in accordance with § 10 of Act no. 122/2013 Coll. on the protection of personal data and on the amendment of certain laws, as amended, without the consent of the persons concerned.
- Consent to the processing of personal data is granted by the Buyer for a period of 5 years, and this consent can be revoked at any time in writing by sending a revocation of consent to the address of the Seller's registered office listed in the header of these GTC, unless the law provides otherwise.
- At the same time, by checking the "I agree to the terms and conditions" box, the buyer confirms that he has been informed of his rights listed in Act no. 122/2013 Coll. on the protection of personal data and on the amendment of certain laws as amended and Act no. 40/1964 Coll. The Civil Code, as amended, in particular for information on the status of personal data processing in the information system, for the correction of incorrect or out-of-date processed personal data, for the disposal of personal data if the purpose of the processing has been fulfilled and for the disposal of personal data if there has been a violation of Act No. . 122/2013 Coll., and that the personal data provided by him match the facts and that they are complete, true and accurate, and at the same time, by checking the box "I wish to receive news by e-mail", he gives his consent for a period of 5 years to send commercial and advertising materials ( so-called newsletters) in any electronic form of messages (via e-mail, SMS) regarding the services provided by the Seller in the experiential Exhibition and its business partners, and it is authorized to revoke the consent given at any time by a written notification sent to the contact address of the operator or to the e-mail address listed directly in newsletters.

Alternative dispute solution
- The Buyer has the right, in the event of a dispute between him and the Seller, to resolve the dispute by means of alternative dispute resolution pursuant to Act no. 391/2015 Coll. on alternative resolution of consumer disputes and on amendments to certain laws.
- The consumer has the right to contact the seller with a request for redress if he is not satisfied with the way in which the seller handled his complaint or if he believes that the seller has violated his rights.
- The consumer has the right to submit a proposal for the initiation of alternative dispute resolution (hereinafter referred to as the "proposal") to the subject of alternative dispute resolution, if the seller answered the request in accordance with point 1 in the negative or did not respond to it within 30 days from the day it was sent.
- The list of alternative dispute resolution entities is published on the website of the Slovak Ministry of Economy, www.mhsr.sk.
- To the proposal, the consumer shall attach documents related to the subject of the dispute, which prove the facts stated in the proposal.
- The proposal can be submitted in paper form, in electronic form or orally in the minutes. To submit a proposal, the consumer can use the form that is available at the seller's headquarters and which is also available on the website of the Ministry of Economy of the Slovak Republic and of each alternative dispute resolution entity.
